Primorsky District Court in Novorossiysk, Krasnodar Krai, has reviewed the case of an administrative offense by CPC-R based on the findings of an inspection of CPC Marine Terminal facilities by the Federal Service for Supervision of Transport as part of federal government supervision of merchant shipping and inland waterway transport safety, as well as the safety of infrastructure facilities in the Azov-Black Sea Basin during loading/unloading of hazardous cargoes.
The field inspection was held in respect of:
• CPC port structures and their operation;
• CPC loading/unloading operations as applicable to hazardous cargoes in inland waterway transport and sea ports, using the single point moorings 1, 2, 3 and the small boat shelter at the CPC Marine Terminal;
• CPC operations to arrange prevention and response to oil and oil product spills at sea from vessels and facilities irrespective of their departmental and national affiliation.
The inspection reviewed 43 regulatory documents available to CPC, including plans, certificates, passports, acts, etc., and examined equipment, including using submersible vehicles.
According to an administrative offense report, the company committed some requirement violations during crude oil transshipment using SPMs. The supervisory authority ordered CPC-R to correct the violations by June 30, 2025.
Liability for such violations is covered by part 3, Article 3.4, and part 4, Article 14.1.2 of the Russian Federation Code of Administrative Offenses, all the way to suspension of operations for up to 90 days.
Having reviewed inspection arguments and documents, the court ruled that administrative liability and an administrative fine should be imposed on CPC-R in the amount of 200,000 rubles without administrative suspension of SPM operations.
